How to prepare a China trademark search before filing

A useful search begins with the mark you will actually use, the goods or services you will sell, and the versions people may recognise in China. An exact-name lookup is a first screen—not a clearance opinion.

What this guide does not do: it does not search live CNIPA records, decide whether a mark is registrable, or replace a qualified professional’s review of similar marks and procedural history.

1. Define the marks, not just the company name

List the exact English word mark, logo, Chinese-character name, pinyin or phonetic version, and any abbreviations used in commerce. Keep each candidate separate. A logo search needs visual comparison as well as word searching, while a Chinese name can raise different language and similarity questions from its English counterpart.

2. Map the commercial scope

Describe what the business sells in ordinary words, then distinguish current products from realistic near-term expansion. China trademark protection is tied to specified goods or services. A Nice class number alone is not a complete filing specification. Use the WIPO Nice Classification as an orientation tool and ask the responsible filing professional to review the China wording and relevant similarity groups.

3. Keep a search record that someone else can review

  • Proposed mark and each variant searched.
  • Classes or goods/services considered.
  • Search date, source and relevant record numbers.
  • Status and owner of any potentially relevant record.
  • Why an apparent conflict may matter—or why further review is needed.

Record screenshots or links where available. Search databases can change; a saved date prevents an old result from being mistaken for a current one. A missing exact match cannot establish availability.

4. Decide the next question, not the outcome

If a similar record appears, the next task is to compare signs, goods/services and procedural status with a qualified professional. If no obvious record appears, the next task is still a fuller clearance review before money is committed to packaging, a distributor agreement or a filing.
